These Terms of Service ("Terms") govern your use of the Curb mobile application ("Curb," "we," "our," or "us"). By creating an account or using Curb, you agree to these Terms.
1. What Curb Does
Curb is a marketplace that connects customers with street food cart vendors. We provide a platform for discovering nearby carts, placing orders, and for cart owners to manage their listings. Curb is a technology platform — we are not a food vendor, restaurant, or food delivery service.
2. Eligibility
You must be at least 13 years old to use Curb. By using the app you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
3. Your Account
You are responsible for maintaining the security of your account credentials. You agree to notify us immediately at ncosenza3@gmail.com if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.
4. Placing Orders
When you place an order through Curb, you are entering into a transaction directly with the cart owner. Curb facilitates the payment and order communication but is not a party to the transaction between you and the vendor.
- Prices are set by individual cart owners and may vary.
- Payment is processed securely via Stripe at the time of order.
- Refunds and disputes are handled on a case-by-case basis. Contact us if you have an issue with an order.
- Cart owners are independent operators and are responsible for food safety, accuracy of menu listings, and order fulfillment.
5. Cart Owner Listings
If you list a food cart on Curb, you agree to:
- Provide accurate information about your cart, location, hours, and menu.
- Comply with all applicable local health, business, and food safety regulations.
- Fulfill orders placed through the platform in a timely manner.
- Not misrepresent your location, availability, or menu items.
We reserve the right to remove listings that violate these Terms or that receive sustained reports of inaccuracy or poor service.
6. Prohibited Conduct
You agree not to:
- Use Curb for any unlawful purpose.
- Submit false, misleading, or fraudulent information.
- Harass, threaten, or abuse other users or cart owners.
- Attempt to gain unauthorized access to our systems.
- Post spam, fake reviews, or manipulate ratings.
- Resell or commercially exploit access to the platform without our consent.
7. Reviews and User Content
By submitting a review or other content, you grant Curb a non-exclusive, royalty-free license to display that content in the app and related materials. You are responsible for ensuring your content is truthful and does not infringe on any third-party rights. We reserve the right to remove content that violates these Terms.
8. Payments and Fees
Customer orders are subject to the price set by the cart owner. Cart owners on paid subscription tiers are subject to the fees disclosed at the time of subscription. Subscription fees are billed monthly and are non-refundable except as required by law.
9. Disclaimers
Curb is provided "as is" without warranties of any kind. We do not guarantee the accuracy of cart locations, hours, or menus, as these are set by independent operators. We are not responsible for food quality, safety, or any issues arising from orders placed through the platform.
10. Limitation of Liability
To the maximum extent permitted by law, Curb and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability to you for any claim shall not exceed the amount you paid to Curb in the 30 days preceding the claim.
11. Termination
We may suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the app ceases immediately.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of Curb after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in California.
